LA NATIVE Starting Rotation

Here's the situation:
I was pulled over immediately after leaving Fridays by CHP. No reason was given and I refused the breath test. Therefore I received a Dui and went to jail. A week later my case was rejected by the DA. Hooray!!
Not Quite, Now DMV has suspended my license for a year on the basis of the police report, which contends I was observed swerving and admitted to being "buzzed" (both lies). I'm not sure what my next option is but was told of something called a writ. Don't waste your time. You refused a breathalyzer - that is an automatic DL suspension. You agreed to that when you first got your license. There is nothing you can do. |

but if you ask for the test at the station, don't you still keep your license? |
You can ask for a blood test. You can usually by a couple hours if you do that. But you are obligated to be tested if a LEO has reason to believe that you have alcohol in your system. |

Note: It is sometimes beneficial to refuse a test. For example if your job depends on it. If you refuse you will have your license suspended, but you will not be convicted of a DUI/DWI. They usually cannot convict you w/o that kind of evidence. |

No, not always, you are in serious jeopardy of losing your license once you refuse the test the fist time. A change of heart at the station doesn’t usually help your cause. |

Doesn't have to be a change of heart. You could easily just say, "I don't trust breath tests, let's go to the station and check my blood." |
Unfortunately we don't have much choice in the matter they really don't care if you don't trust the breath test. You probably can request a blood test in addition to the breath test but you can't refuse the breath test without running the risk of losing your license.
Now who knows maybe you might run into an accommodating officer who is willing to take you in to get the blood test but it isn't likely. Just make sure you never out right reject the breath test before you request an alternative.

You should get a lawyer for your penalty, but implied consent is something that goes along with when you get your license, there is nothing you can do about them putting you in jail. But I don't know if your license should have been revoked. You should hire a lawyer to sort out the report and maybe file a complaint about the punishment......... |
