She's 85. If she would stay active I'd like to see her retire. Doing nothing would not be good.

Seconds thoughts. Maybe RBG should stay until Trump is defeated. Oliver Wendell Holmes retired at age 90. Wishing her God Speed on healing.

Well I mean she only has to make it 13 more months. Once 2020 starts we can’t possibly approve a Supreme Court Justice in an election year. We’d have to wait for the people to be heard. I mean surely since this is the precedent set by McConnell he would follow it even during a republican admin right guys? Right?

Because Mr. Whitaker has not undergone the process of Senate confirmation, there has been no mechanism for scrutinizing whether he has the character and ability to evenhandedly enforce the law in such a position of grave responsibility. The public is entitled to that assurance, especially since Mr. Whitaker’s only supervisor is President Trump himself, and the president is hopelessly compromised by the Mueller investigation. That is why adherence to the requirements of the Appointments Clause is so important here, and always.

Funny how that dire crisis seems to have melted away. Hmmm.

I've seen conflicting opinions on whether that applies to "interim" replacements.

Yea sure is interesting how quiet Trump, Fox News and other conservatives are on THE CARAVAN now that the midterms are over. I thought this caravan was an existential threat to our American way of life that had to be stopped at all costs?

I don't think it is constitutional for a non-appointed/non-vetted person to make such critical decisions. Otherwise a President could have a parade of interim heads of agencies make decisions based on his or her whim.

Hence the discussion in whether it applies to temporary appointees.
